This page tells you the terms and conditions on which we supply any of the products (Products) listed on this website to you. Please read these terms and conditions carefully before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.
Before placing an order with us you will be required to accept these terms and conditions. You can refuse to accept these terms and conditions, but please understand that if you refuse to accept these terms and conditions, you will not be able to order any Products from our site.
1. INFORMATION ABOUT US
1.1 www.fruin.biz is a website operated by Nadine Fruin. FRUIN is registered in the Netherlands under company number 56562497. Our VAT registration number is NL145636458B01.
2. YOUR STATUS
2.1 By placing an order through our site, you warrant that you are legally capable of entering into binding contracts.
3. ORDERING ON fruin.biz
3.1 All prices are shown in Euro, taxes and shipping costs within the EU included. The total amount is clearly visible per product and in the shopping basket clients must confirm before concluding the Order process.
4. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
4.1 If you decide to order some of our Products from this website, you can select the Products to be ordered, which will be included in your “shopping basket”. After placing an order, you will receive an order confirmation from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. The contract is valid if FRUIN accepts the order and sends a confirmation of the acceptance by mail. Please read the order confirmation and notify FRUIN immediately by writing in case of any discrepancies. By posting an order you accept these conditions. FRUIN has the right to refuse any order without any reason. All offers from FRUIN are without obligation. If FRUIN can’t perform the order because of an unforeseen reason this will be communicated to you as soon as possible. The Client can’t claim any compensation based on unforeseen circumstances. FRUIN reserves the right to change products and FRUIN guarantees an equivalent functionality and performance.
5. AVAILABILITY AND DELIVERY
5.1 Products offered on fruin.biz are made on demand and specifically for each Client. FRUIN aims to deliver goods within 4 weeks of receipt of order for deliveries within the EU and 6 weeks for deliveries for NON EU and rest of the world countries. Your order will be fulfilled by the delivery date set out in the Confirmation of Acceptance mail.
5.2 We have tried our utmost to portray the detail, colours and leather texture of the footwear correctly. However, due to photographic variation and computer settings please allow for slight variation.
6. RISK AND TITLE
6.1 The Products will be at your risk from the time of delivery.
6.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
7. PRICE AND PAYMENT
7.1 The price of any Products will be as quoted on our site, except in cases of obvious error.
7.2 The price includes VAT and shipping costs within the EU, but exclude delivery costs to Non EU countries. These costs will be added to the total amount due for each Product ordered.
7.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Confirmation of Acceptance.
7.4 Payment for all Products must be in Euro using the facilities given on the site. We accept payment with iDEAL, Mastercard, Visa and Maestro.
8. YOUR RIGHT TO CANCEL
8.1 Once the order has been made and you have received the Confirmation of Acceptance mail it is not possible to cancel.
9. NON-COMPLIANCE COMPLAINTS AND RETURN POLICY
9.1 The client shall check the goods immediately upon delivery, to determine compliance with the order.
9.2 Any defect (i.e. tampering packaging or products damages, missing items or items different to those ordered and/or indicated in the shipment document) will be specifically described in writing directly on the delivery document to be signed by the Client.
9.3 When you return a Product to us (because you claim that the Product is defective or non-compliant), we will examine the returned Product and will notify you of your refund or exchange via e-mail within a reasonable period of time. We try to process returns as soon as they arrive. However, during very busy periods, please allow 10 days for your refund or exchange to be processed. We will usually refund any money owed to you using the same method originally used by you to pay for your purchase.
9.4 If you are not completely satisfied with your mail order purchase you can return your order to us at any time within ten (10) days of receipt, for a full refund on the cost of the Products or an exchange. Products must be returned unworn and undamaged in their original packaging with the original purchase receipt.
9.5 To return: complete the Returns Form that is included in your parcel indicating clearly whether you would like an exchange or a refund. The product must be returned in its box and with the tissue paper intact. Take your parcel to the nearest post office and post, or alternatively follow the International Returns instructions included in your parcel. We recommend that you send returns by special delivery so that they are insured for you and are traceable. The cost of returning Products to FRUIN is borne by you.
9.6 All FRUIN Products are checked for quality before they are sent to you. Customers can expect FRUIN Products to remain of satisfactory quality throughout their reasonable life expectancy, so long as they are maintained correctly and not misused. Footwear should only be fitted on carpet for protection. Returned goods found to be worn, damaged, marked, soiled or scratched will not be refunded or exchanged. FRUIN cannot guarantee against standard wear and tear and we reserve the right to seek a second opinion from an independent body when defect inspections are required. If the product is deemed to have a manufacturing defect or is not fit for purpose we will offer an exchange or refund.
9.7 Returned Products must be in their original packaging. We reserve the right to deduct the value of repackaging for any Products not returned in their original packaging. All returns should be accompanied by original documentation for credit purposes, and clearly state the reason for return. Refunds or exchanges will not usually be given for Products returned without a FRUIN returns form and full adherence to our terms and conditions. We advise that you use a traceable and insured postal service to return your products to us; or alternatively follow the International Returns instructions included in your parcel, we cannot be held responsible for goods lost in transit. Postage charges for returned Products are the full responsibility of the purchaser, and are non-refundable by FRUIN. In the case of an exchange, postage charges to deliver the new item to the purchaser are the full responsibility of the purchaser and are non-refundable by FRUIN.
10. EVENTS OUTSIDE OUR CONTROL
10.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event), including (without limitation) the following:
10.1.1 Strikes, lock-outs or other industrial action.
10.1.2 Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
10.1.3 Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
10.1.4 Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
10.1.5 Impossibility of the use of public or private telecommunications networks.
10.1.6 The acts, decrees, legislation, regulations or restrictions of any government.
10.2 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
11. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
11.1 We have the right to revise and amend these terms and conditions from time to time.
11.2 You will be subject to the policies and terms and conditions in force and posted onto our website at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).
12. LAW AND JURISDICTION
12.1 Contracts for the purchase of Products through our site will be governed by Dutch law.
